Registered charity number 20003326 in the Republic of Ireland, whose registered office is at West Quay Road, Poole, Dorset, BH15 1HZ. References in these Terms to 'we' or 'us' are to the RNLI. We amend these terms from time to time and the amended terms will apply from the date we post them. Every time you wish to use our site, please check these terms to ensure you understand the terms that apply at that time. We may make changes to our site. We may update and change the format and content of GIS Open Data website from time to time. You should refresh your browser each time you visit our sites to ensure that you access the most up to date version. Terms of Use for GIS Open Data website – Open Licence If you don't accept these terms, please don't use our GIS Open Data website. If you use our website, you will be bound by these terms and they will form a contract between you and us. RNLI is the Information Provider for the purposes of this Licence. 1. Using Information under this Licence 1.1 Use of the data contained under GIS Open Data website, use of copyright and database right material expressly made available under this Licence (the 'Open Data') indicates your acceptance of the terms of this Licence. 1.2 In consideration of you agreeing to comply with the terms of this Licence, the RNLI hereby grants you a revocable, worldwide, non-exclusive, royalty-free, non-transferable, non sub-licensable licence to use the Open Data subject to the terms of this Licence and for the following uses only: (a) copy, publish, distribute and transmit the Open Data; (b) to exploit the Open Data for commercial and non-commercial purposes by, for example, combining it with other information, or including it in your own products or application; and (c) to adapt the Open Data into different formats for the purposes of data mapping (or otherwise for display or presentation purposes). 1.3 When using the Open Data in any way, you must: (a) acknowledge the source of the Open Data in your product or application by including the following attribution statement: "Contains Open Data licensed under the GIS Open Data Licence" and, where possible, provide a link to this Licence; (b) If you are using Information from several open data providers and listing multiple attributions is not practical in your product or application, you may include a URI or hyperlink to a resource that contains the required attribution statements; (c) Not change the content of any Open Data; (d) Not use or present the Open Data or any analysis of it in a way that is unfair or misleading, for example comparisons must be based on objective criteria and not be prejudiced by commercial interests; (e) Not use or present the Open Data, in any way or for any purpose which is in breach of any rights of any third party (including intellectual property rights) or of applicable law or regulation in the United Kingdom or is inconsistent with this Licence; (f) The material is not used in a manner which may damage our reputation or otherwise be harmful to us or impair our ability to achieve our charitable objects; and (g) Indicate if you modified the Open Data and any licensed material and retain an indication of any previous modifications. 1.4 When using the link to our website: (a) The link must simply consist of either the website address or any linking logo which we have given you permission to use; (b) You do not remove, distort or otherwise alter the size or appearance of any logos on the site; (c) You do not in any way imply that we are endorsing any products or services; (d) You do not misrepresent your relationship with us nor present any other false information about us; (e) You do not otherwise use any RNLI trade marks displayed on our sites without our express written permission; (f) You do not link from a website that is not owned by you; (g) Your website does not contain content that is distasteful, pornographic, infringes any intellectual property rights or other rights of any other person or otherwise does not comply with all applicable laws and regulations; and (h) At any time and at our complete discretion we reserve the right to withdraw the permission to make website links to our sites. 1.5 These are important conditions of Licence and if you fail to comply with this clause or any other terms of this Licence, the rights granted to you under this Licence, or any similar licence granted by RNLI, will end automatically. 2. Exemptions 2.1 This Licence does not cover: a) personal data in the Open Data; b) third party rights the RNLI is not authorised to license; and c) other intellectual property rights, including moral rights, patents, trade marks, and design rights. 3. Disclaimers and Limitation of Liability 3.1 Whilst we endeavour to ensure that the information on our website is correct, we do not warrant the accuracy and completeness of that information. The material on our website is as-is and as-available and may be out of date. 3.2 We do not warrant that the functions contained on our websites will be uninterrupted or error-free, that defects will be corrected, or that our sites or the server that makes them available are free of viruses or bugs or represent full functionality, accuracy or reliability of the materials.
